Cheryl Peterson of Heritage was present when Cliff Matthews opened the continued hearing for a 13 lot residential subdivision proposed on North St. Cheryl Peterson stated that she had spoken with Anne Matthews earlier in the day to discuss the completion of the project. Anne Matthews stated that the Conservation Commission will require the same sets of plans and drainage calculations as referenced by the Planning Board. Ms. Peterson will provide two more copies of the revised plans dated July 28, 2010 and one copy of the Stormwater Report dated June 21, 2010. Ms. Peterson will also confirm that all current plans have been copied to DEP. The stormwater annuity principal of $64,000 was also discussed. Ms. Peterson understood that the annual interest generated from the principal would be used by the town for maintenance of
the stormwater structures once the town accepts the roads in the subdivision. The Planning Board and DPW Director are all satisfied that all outstanding issues have been addressed. The Conservation Commission stated that they would endorse a cluster layout should the applicant consider a change from the conventional layout to a cluster layout in the future. Ms. Peterson will submit plans as mentioned earlier and agreed to another continuation. By unanimous vote, the hearing was continued to August 25, 2010 at 8:45 PM.

Romeo LaCombe and Bill Halsing of Land Planning as well as Larry Sposato, an abutter, were present when the hearing was opened. Bill Halsing stated that the site currently has an old cesspool that the applicant would like to replace with a Title V system. feet from the resource area. The system would pump into the new leach field that would be located outside the 100 foot buffer zone. There would be little disturbance as the area is currently lawn. Special Conditions discussed
include: stockpiling all excavated materials and new construction materials outside the buffer zone, pumping and filling of the old cesspool, and notifying George Holmes for inspection of the siltation controls. There were no further questions or comments. The Commission voted unanimously to close the hearing and issue an Order of Conditions.

The Commission scheduled a site walk for and Enforcement Order for Mechanic Street, Dave Brown, on Monday, August 16th at 6:00 PM to assess the progress that the owner is making addressing the violation.
George Holmes stated that Ann McMenemy has submitted information on permanent wetland flagging as requested by the Commission in response to the applicant’s request for another Extension to Order of Resource Delineation, DEP #105-559 (The Shoppes). The Board discussed both the advantages and disadvantages of installing aluminum wetland tags on trees and also the length of time that the applicant proposes to complete the tasks. The Commission had a clear consensus that we would recommend using the standard vinyl flags to re-establish the wetland boundary. The Board also discussed the applicant’s request for a three year extension. After lengthy discussion, the issue was tabled for further discussion.
Since the Commission has received the recording information for the Certificate of Compliance for 146 North Main St., Marty’s Auto, the Board members voted to authorize the Chairman to write a letter to the Treasurer releasing the replication bond for #105-609.
